AIBA urges stringent action against Google for spreading false information

New Delhi, March 3, 2024- The All-India Bar Association (AIBA) has recently written to Prime Minister Narendra Modi, urging robust legal measures against tech giant Google for allegedly disseminating false information aimed at tarnishing the image of the Prime Minister.

Dr. Adish C. Aggarwala, Senior Advocate and Chairman of AIBA, pointed out that Google’s artificial intelligence platform, Gemini, had engaged in disseminating misleading and mischievous information, potentially violating Sections 153A, 500, and 505 of the Indian Penal Code. These sections pertain to promoting enmity among groups and spreading false information in the public domain.

As the President of the Supreme Court Bar Association (SCBA), Dr. Aggarwala emphasized that the responsibility for the content lies with the creator of the machine, in this case, Google. He highlighted the importance of holding the company accountable for the consequences of the false information disseminated by its AI platform.

The letter underscored the timing of these allegations, noting that India is on the verge of a general election. Dr. Aggarwala stressed the need to curb malicious campaigns that seek to smear the image of any political leader, especially during a crucial period for the nation.

“The Prime Minister of India has tirelessly worked to elevate the country’s standing on the global stage. However, there are elements who may seek to undermine these efforts by spreading baseless accusations. Such actions must be promptly addressed,” the letter emphasized.

AIBA urged the invocation of penal laws and decisive action against those found guilty of orchestrating the alleged misinformation campaign. The association asserted that preserving the honor of the nation and its leaders is paramount, especially in the lead-up to a significant election.

The matter raises concerns about the role of technology giants in influencing public opinion and the potential consequences of their AI platforms disseminating misleading information. The AIBA’s appeal to the Prime Minister underscores the importance of safeguarding the integrity of information, particularly in the context of a democratic process such as a general election.
