Patna High Court rules that Bihar’s plan to increase the quota to 65% violates people’s rights to equality

Patna : The Bihar government’s announcements to increase reservation from 50% to 65% in government employment and educational institutions were overturned by the Patna High Court on Thursday.

The Mahagathbandhan administration, headed by Nitish Kumar, increased the Bihar quota slab to 65% on November 7, 2023. When the 10% quota for economically disadvantaged sectors (EWS) is taken into account, this essentially made the state’s reserve rate 75%.

Chief Justice K Vinod Chandan of the High Court and Justice Harish Kumar, forming a division bench, invalidated the government’s notifications on the grounds that they “infringe upon right to equality.” Rakesh Kumar and other residents of Nalanda petitioned for this to happen.
