New Delhi, Feb 6 ,2025: In a landmark decision, the Supreme Court on Thursday ordered the transfer of all pending petitions related to the results of the Common Law Admission Test (CLAT) 2025 for undergraduate courses to the Delhi High Court.
A bench consisting of Chief Justice of India (CJI) Sanjiv Khanna, Justice PV Sanjay Kumar, and Justice KV Viswanathan issued the directive to ensure consistency and avoid conflicting rulings across different High Courts.
The court instructed that the petitions be listed before the Delhi High Court on March 3, 2025. It also directed that the registrar of each High Court send the relevant case papers to Delhi High Court within seven days of the order.
The decision followed a request from the NLU Consortium, which sought a consolidated hearing for the CLAT-related petitions, currently pending in the Delhi, Rajasthan, Punjab and Haryana High Courts.
The controversy began on December 20 when the Delhi High Court’s single-judge bench, led by Justice Jyoti Singh, partially upheld a plea from 17-year-old CLAT candidate Aditya, who alleged errors in the exam paper for admissions to National Law Universities (NLUs). Justice Singh identified clear errors in two out of five disputed questions and directed the Consortium to revise the results accordingly.
This ruling was contested by both the NLU Consortium and Aditya before a Division Bench. While the Consortium argued that the single-judge had exceeded his authority by altering expert-decided answers, Aditya sought corrections for three additional questions, claiming they contained significant errors.
The issue intensified when the Consortium approached the Supreme Court, requesting the consolidation of petitions under one High Court to avoid conflicting judgments. The dispute also extends to the CLAT PG exam, where discrepancies in answer keys are being contested before the Madhya Pradesh and Bombay High Courts.
