Wrapping up the debate on ‘Punjab Apartment and Property Regulation (Amendment) Act-2024’ in the House of Vidhan Sabha, the Chief Minister said that the purpose of this amendment is to clamp down on illegal colonies, while giving relief to small plot owners. . He said that this bill will bring great relief to the common people because with this amendment, the problem faced by the people in getting their plots registered will end and unauthorized colonies will be stopped. Bhagwant Singh Mann said that the amendment provides for fines and punishment for the guilty people. He said that the purpose of this historic decision is to ensure the welfare of the common people.
The Chief Minister said that as per the new amendment, any person who, by July 31, 2024, has executed a power of attorney, agreement to sell on stamp paper or any other such document for an area up to 500 square yards located in an unauthorized colony. The NOC for the area contracted through which the Government may by notification specify. will not be required. The chief minister said that the owner of this property can get his plot registered with the concerned registrar or sub-registrar or joint sub-registrar and this exemption for registration of such land will be applicable till the date notified by the government through a notification in this regard. . There will be no need to obtain He said that the information of such sale document will be provided by the Registrar or Sub-Registrar or Joint Sub-Registrar to the concerned authority. The Chief Minister informed that even after the expiry of the notified date of exemption given as above, if the said property has not been further distributed, then the Registrar or Sub-Registrar or Joint Sub-Registrar may issue subsequent sale deeds in respect of such property. Information interests of development authorities/local government will be registered.
The Chief Minister said that any person or promoter or his agent and any other promoter registered under the Act, who, without any reasonable cause, fails to comply with the provisions of Section-5 of the Act or contravenes the provisions thereof shall be guilty of If found, he can face a minimum fine of Rs 25 lakh which can be extended up to Rs five crore. Along with this, he will be sentenced to imprisonment for a minimum of five years which may extend to ten years. He said that the illegal colonizers robbed the people by showing them vegetables and they sold the colonies without permission while these colonies are devoid of street lights, sewerage and other basic facilities. Bhagwant Singh Mann said that helpless people are struggling to get the required facilities in these colonies.
The Chief Minister said that the colonizers collect money illegally but the people have to bear the brunt of their wrongdoing. He said that the previous governments had regularized illegal colonies thrice while each time the condition was imposed that this relief was for the last time. Bhagwant Singh Mann said that being one of the most experienced Chief Ministers of the country, he has taken this decision to legalize common people’s plots and not illegal colonies.
The Chief Minister said that the state government has introduced colored Ashtam papers to facilitate investors in obtaining necessary approvals. He said that this will ensure that the land is used only for the purpose for which the investors sought approvals. Bhagwant Singh Mann said that illegal colonies increased during the long misrule of the previous governments because the previous governments patronized the illegal colonizers.
The Chief Minister said that this bill will provide a huge relief to those crores of people who have mistakenly invested their hard earned money in illegal colonies. He said that these naive people had invested their money to build houses but got into trouble due to illegal colonies. Bhagwant Singh Mann said that the public will never forgive the leaders who shelter the illegal colonizers and people have already shown them the exit door.
The Chief Minister said that now the leaders are apologizing for their bad deeds, while they themselves do not know what wrong they have done. He sarcastically said that these leaders are now apologizing for what they have done but they should remember one thing that mistakes can be apologized for but crimes are not forgiven. Bhagwant Singh Mann said that these leaders have committed heinous crimes against the state and its people, which can never be forgiven.
